進步性

進步性係取得發明專利的要件之一，此要件之判斷後於新穎性要件，依專利法第22條第2項規定，申請專利之發明雖無喪失新穎性之情事，但為其所屬技術領域中具有通常知識者依申請前之先前技術所能輕易完成時，不具進步性，仍不得取得發明專利。
