對刑罰感應力薄弱

行為人曾因犯罪受罰，理應產生警惕作用，返回社會後能自我控管，竟又再犯罪，足見前罪之刑罰無成效，行為人對刑罰感應力薄弱，基於特別預防之法理，並兼顧社會防衛之效果，法院可裁量加重處罰。
