廢弛職務釀成災害罪

廢弛職務釀成災害罪規定於刑法第130條，是指公務員對於某種災害，有預防或遏止之職務上義務，如廢弛自己職務，不為預防或遏止，以致釀成災害，且其廢弛與災害之發生如具有相當因果關係，即構成本條犯罪。
