從一重處斷

係指當想像競合犯之情形，行為人同時犯多數罪名時，不能各罪重複處罰，而應擇其中最重罪處罰之。依刑法第55條規定「一行為而觸犯數罪名者，從一重處斷。但不得科以較輕罪名所定最輕本刑以下之刑。」
