人別訊問

檢察官或法官為了要確認偵查或審判訊問的對象是否正確，於開庭時會先詢問姓名、出生年月日、住居所等年籍資料，此一程序，即稱為人別訊問。

訊問被告，應先詢其姓名、年齡、籍貫、職業、住、居所，以查驗其人有無錯誤，如係錯誤，應即釋放。
