逮捕前置原則

必須先經合法的拘提或逮捕程序，檢察官才能聲請羈押；若被告是因傳喚、自首或自行到場，檢察官認為有羈押的必要及原因者，依刑事訴訟法第228條第4項但書規定，可先予逮捕後，再聲請羈押。
