公眾週知之事實

係指具有通常知識經驗之一般人所通曉且無可置疑而顯著之事實而言，如該事實非一般人所知悉或並非顯著或尚有爭執，即與公眾週知事實之性質，尚不相當，自仍應舉證證明，始可認定，否則即有違認定事實應憑證據之法則。
