無過失責任

造成損害時，即使不存在故意或過失，也要承擔損害賠償的責任。

例如：國家賠償法第3條規定，公有公共設施設置或管理有欠缺，不問是誰有故意、過失，只要造成人民損害，國家即應負賠償責任。
