係指基於確認之訴之聲明，確認當事人間法律關係成立或不成立、確認證書真偽、或確認其他必要事項之判決。

尚包括所有以原告之訴為無理由而駁回原告之訴之判決，均屬確認判決，生確認原告主張權利不存在之既判力。
