占有請求權

占有人為維持占有的原狀，對於妨害其占有狀態者，請求返還、除去或防止妨害的權利（民法第962條）。

例如 承租人是租賃物的直接占有人，除非其違反租賃契約，出租人不得妨害承租人使用租賃物，否則承租人可對出租人主張占有請求權。
