抵押權設定

為確保債權的履行,由債權人債務人第三人訂立書面契約,約定在不移轉占有的情形下,由債務人或第三人提供不動產供債權人擔保所為之設定登記。債務人若無法清償債務,債權人得拍賣該已設定抵押權之不動產,並就賣得價金優先於普通債權人受清償。
